were arrested when the 49ers wrapped up that nfc championship game. of course our coverage of the 49ers quest for six rolls on all week long. we have the most local journalists on the field down in new orleans taking care of business. live coverage all week long starting at 5:00 a.m. and we'll have a live report for you. another one coming up in 20 minutes from now. of course you can get the behind the scenes access on our website, nbcbayarea.com. in the meantime a former 49er is facing possible jail time. harris is accused of beating up his ex-boyfriend. the 30 year old pleaded not guilty to felony domestic violence and assault charges. he's scheduled to go on trial in april. he got into his fight with his ex-boyfriend in august. his lawyer says harris was acting in self-defense. harris was the first round draft pick by the niners out of stanford back in 2003. he also played for the raiders but he faces now up to nine years in prison.

the search continues for the gunman who shot an 8-year-old girl while she was simply standing in her own front yard in oakland. christie smith is live in the east bay with more details on the young victim and what police are right now planning to do today. christie, good morning. >> reporter: good morning, jon. oakland police are still looking for the shooter as the city has gotten off to a violent start this year. not only that child shot but two oakland police officers. two of them shot and wounded leaving one councilman to once again say we are completely out of control and bringing back calls for a state of emergency here in oakland. just yesterday afternoon an 8-year-old girl was shot in the leg during a drive-by shooting on 65th avenue in east oakland. she was standing with others outside when a car drove by and someone, maybe two people inside, opened fire. police believe that the shooting may have been gang related. good news, the girl is expected to recover.

chief howard jordan says his appearance at the scene was designed to send a specific message. >> if my being out here sends a message that the department is taking it seriously, i'll be out here every time that happens. >> reporter: now in oakland of course frightening and sad but children have been shot before. recently as innocent bystanders including a 3-year-old in east oakland with his family killed by a stray bullet. a toddler in west oakland and also 5-year-old gabriel martinez shot near his family's taco truck in east oakland. police expected to hold a press conference later this morning about 11:15 to talk about the two officers who were wounded but no doubt the 8 year old will come up as well. reporting live in oakland, christie smith, "today in the bay." >> thank you, christie. vallejo police are now involved in a hazing investigation at a catholic high school that led to five students being expelled. police say several freshmen football players at st.

patrick-st. vincent high school reported they were victims of sexual hazing rituals at the hands of the varsity players. the coach has since been fired and five of the alleged offenders have been expelled. the family of a walnut creek man shot and killed by police last month is now suing that police department. officers shot 22-year-old anthony banta back on december 22nd after he charged at them with a knife. police say banta got in a fight with his roommate before officers arrived on scene. banta's family say the fight was over before police arrived and one officer fired his gun in a panic after another officer tripped and fell behind him. banta's family is suing four members of the police department for $15 million in damages. want to switch gears and check in with meteorologist rob mayeda in for christina this morning with a look at the forecast. >> the forecast looks nice. warmer heading toward the middle part of the week. this morning we have

temperatures again in the 30s and 40s outside. down to 37 in san jose. definitely thick winter coat weather. 45 in san francisco. 39 in livermore. not too much wind right now but by afternoon we'll see winds picking up out of the northwest 10 to 20 miles an hour. high clouds coming in north to south. sun filtered at times today but high pressure builds in from the west will lead to warming temperatures mostly 60s, maybe even near 70 by the end of the week in a few spots. today mainly 50s. upper 50s around san jose. a few low 60s around the north bay inland valleys out toward santa rosa. 56 in san francisco. and the seven-day forecast warms things up. mid 60s around the bay area thursday and friday. and then a cooldown with a few extra clouds for the weekend. weather looks good. tracking issues in the north bay, mike? >> we'll look at this live shot of san rafael. as we take it to full screen around the bend northbound

taillights i saw chp flashing lights. they pulled someone over. they had a discussion and made their way off the freeway. clear from lanes though. we'll look at maps and show you what else is going on. 101 both directions between richmond san rafael bridge and the exit we do have construction going on in either direction. no slowing. only a lane or two blocked right now. light flow of traffic. richmond san rafael bridge from the right. on that bridge we do have a vehicle stalled reported coming past the toll plaza. you can see that little yellow blip there making your way over the water and that westbound deck is having to deal with that stalled vehicle. it sounds like it's on the shoulder. narrow shoulder there. a live look at emeryville. westbound 80 coming down through berkeley. smooth flow here and we'll end with a look at the san mateo bridge. light flow of traffic. things will pick up. we'll send it back to you. >> thanks so much, mike. impromptu display of love in the south bay will be going

away. for months couples have been hanging personalized padlocks on the main street bridge in los gatos as a symbol of love for each other. officials worry it's becoming a safety hazard. bob redell is live in los gatos with what the town council plans to do about it. good morning, bob. >> reporter: good morning, laura. to give you history, a married couple attached this first lock. this was in august. you can see it there to commemorate their 30th anniversary. they thought it would be a nice way to do so. ever since as you can see other people have been attaching their own so-called love locks. there's not much love from caltrans which owns this bridge. they are concerned the weight of these locks will compromise the flimsy fence especially if there were a wind storm. the concern is that the extra weight would cause it to knock down and hit cars on highway 17 below. the city of los gatos which is responsible for maintaining anything on this deck and above will take down the locks on friday. some people think it's an

overreaction. we're showing a video of the museum of los gatos offering residents a new place to hang their locks. it will be an art exhibit that will include a chain link fence and represent a bridge. that's supposed to be unveiled on valentine's day. love locks are relatively new to the bay area but not to the rest of the world. look at pictures that my colleagues snapped on trips to paris and florence where you can see love locks are attached to bridges there. it's my understanding that when authorities there cut down the locks for safety reasons, they just throw them away. that's not going to be the case here in los gatos. a lock removal sign here on the main street bridge. they'll cut them down on friday. they'll keep them at the los gatos corporation yard until february 15th. that's the day after valentine's day. they will cut them down but if you have one of your love locks that you're not going to take down yourself, you do have until february 15th to collect it. reporting live on the main

vmware shares fell on news of the trouble. yahoo! reported profits after the bell on monday afternoon financially better than wall street expected. we'll have more coming up in just a bit. for a look at the broader markets, let's turn to jackie deangelis live at cnbc world headquarters. good morning, jackie. >> reporter: good morning, scott. futures pointing to a slightly lower open after the markets took a breather on monday. the dow snapping a seven-day win streak. tech may get a boost today. watch for it after yahoo! reported decent earnings last night we'll get data on home prices and consumer confidence and also earnings from ford, eli lilly and pfizer. the fed kicks off a two-day meeting but widely expected to keep to its message which is keeping rates low for a long time. dow falling 14 points. the nasdaq edging slightly higher yesterday up four points to 3154. back over to you. >> all right. thank you much. as we mentioned, jon, we'll talk

about yahoo! in a bit. it's a personality story about marissa mayer. wall street absolutely still thinks she's the woman for the job. we'll take a look at that coming up in just a bit. >> she does have rock star status. thank you very much. this one a wild scene along the australian coast. you have to see it to believe it. that's not as scott mcgrew thought root beer. that's sea foam swallowing up beaches. it looks fun. a tropical cyclone now being blamed for bringing all that foam as much as ten feet deep there. you can see they are taking advantage of this. town officials say that foam good news it is not dangerous to humans and is not expected to last too long. since it is not dangerous, that's just a big party going off there. >> i have never seen anything like that. >> very interesting. won't see any of that around the

bay area. we'll see temperatures warming up. it is summer down in australia. here i know it's middle of winter but 70s possibly could be coming back later on this week. outside right now 30s and 40s outside. 36 degrees in napa. and san jose and morgan hill some of the cooler spots this morning. mid 30s to get the day started with high clouds going by. the wind not much of a factor yet. high pressure builds in from the west over northern california we'll see northwest winds picking up into the afternoon. chilly start. high clouds at times. the sun will take on a filtered appearance through the day today. the winds picking up gusty in the north bay hills during the afternoon. and then warming temperatures lots of 60s and maybe even close to 70. the high clouds we're seeing right now moving north to south. we've been kind of stuck in the pattern but that's now heading off toward the east into the central plains and with high pressure building in, sinking

dry warm air aloft. won't see too much of it today. wednesday, thursday, friday, widespread 60s and for santa cruz could see 70s to wrap up the week. today around the bay area, upper 50s close to 60 in santa cruz. once the north winds get going in inland valleys and out toward napa county, could see low 60s today. close to 60 in pleasanton around the tri-valley and into santa rosa. 62 degrees. 56 in san francisco. and close to 59 degrees in oakland. the three-day forecast, next three days we see temperatures going up a couple degrees each day. as winds turn offshore look at the coast at the bottom of the screen. mid to upper 60s there. a gorgeous beach day for january into february. and for the weekend a few extra clouds but staying dry. nice for super bowl sunday viewing plans there. >> looks like 60s but i'll be a 49er. looking over to the bay bridge toll plaza. folks traveling into the city, easy drive right now. no metering lights. no problem for the span. east shore freeway moves at the limit both westbound commute

direction and east heading away from the bridge. we'll get a look at oakland where you are heading north through downtown and toward the span itself. smooth drive here. picking up more cars in either direction. volume starts to build just after 5:00 as we see right here. we'll show you the same area on the maps with construction both directions between 980 and 16th both directions do have crews and we'll see slowing heading up toward the high street. crews should move north of there in the next few minutes. we do have a couple of crashes to report. one is southbound 880 approaching the san mateo bridge and a street. reports of a couple cars that hit debris. a couple flat tires on the shoulder. we'll check it out because chp does get reports of metal debris in the roadway. clear that out if they can. get a sweeper. that will cause slowdowns. i'll track that and let you know. approaching dublin interchange westbound. a new crash at the interchange and you see slowing so use caution approaching that major tri-valley commute spot.

a smooth drive right now for 680. quick look outside and we see across the bay palo alto moves nicely here and south bay no incidents and no issues. we'll show you volume there for 101 as well. there you go. back to you. >> all right. thank you very much. it's 5:19. prosecutors have dropped a serious charge against a private contractor accused of being responsible for massive wildfires in santa cruz mountains back in 2008. he faced a felony reckless burning charge for the summit fire that started in may. lawyers had argued he failed to properly extinguish a controlled burn which eventually reignited and destroyed 63 homes. yesterday prosecutors dropped the charge saying there wasn't enough evidence to prove recklessness. he still face as misdemeanor charge he has pleaded not guilty. the chp needs your help this morning trying to track down the drivers who took part in a side show on 880. you can see the evidence left behind there. there's tire marks all over the

freeway on northbound 880. that's near the oakland coliseum. police saturday afternoon around 4:00 say several drivers you can see here video from youtube did burnouts all along that freeway just blocking up the lanes and snarling up traffic. spectators recorded that chaos on phones and posted it on youtube. the chp right now using this video to try to identify the suspects who have very heavy feet. >> amazing. 5:20 right now. another check of your forecast with rob mayeda coming up. smoking about to be banned at one outdoor city. niners try to win the sixth super bowl title. we'll go back to one of the past wins.

welcome back, everyone. a live look outside at san francisco international airport. you can see the traffic running there along 101. coming or going this morning, we'll help you get out the door if that's where you're headed and a look at the forecast as well. 5:23 right now. a house fire in san jose that sent two firefighters to the hospital is now under investigation this morning. they were taken to the hospital and treated for minor injuries. they were battling a blaze around noon yesterday at a home on holly drive near talent avenue. the red cross is assisting it with six adults and five children who were left homeless. it could get even tougher to light up in san francisco later on today the board of supervisors could approve a proposal to ban smoking at certain street fairs and festivals. organizers would have to promote their events as smoke free. another proposal would force landlords to disclose whether their buildings allow smoking to potential tenants. backers say most people are simply unaware their neighbors are allowed to smoke. >> let's clear the air so to

speak checking that forecast with meteorologist rob mayeda. >> this morning we see high clouds in the air moving over the bay area from north to south making for a stunning sunrise after 7:00 this morning. as we show you the satellite view, high pressure is acting like a wall. no storms over the ridge in the next few days. hour by hour, 9:00, 40s and 50s outside. by lunchtime close to 60 out toward napa and near fairfield. mild temperatures there. but if you are looking for t-shirt weather for the rest of the bay area, as we pass the middle part of the week that looks good. mid 60s for highs even out to the coast as we wrap up the week and then we'll see cooling. a few extra clouds heading toward the weekend. mike? >> we have the san mateo bridge with smooth drive right now. let me show you what's going on as you approach from 880 on the maps. we do have an incident marked on our flow there. southbound 880 approaching 92. the metal debris was a hot dog cart. a 96 buick century hit it.

major damage to the buick, car and hot dog cart. we do have metal debris through the area and a lot of nitrates. be careful. the car is damaged. i'm not sure about the dogs. moving smoothly through 580 westbound at 680 because there's slowing they did just clear that minor fender-bender from the roadway that was just underneath the over crossing. there will be slowing for a few minutes but not a big deal. slowing out of the altamont pass. back to you. >> wait until you see this. a sinkhole swallowing up several buildings in china all caught on tape. check it out. a three story building. look at that. it just collapsed into the hole yesterday afternoon. hours later another large building just devoured. workers now trying to fill in that hole and surprisingly no one was hurt. >> that's a huge lake out there. mind-blowing no one got hurt. good news. fun to watch but very scary to

website, nbcbayarea.com. oakland police chief howard jordan vowing to take action after a drive-by shooting sends a very young girl to the hospital. "today in the bay's" christie smith is live in oakland with more details on the young victim and the latest on this investigation. christie, good morning. >> reporter: good morning to you jon. hard to believe an 8-year-old girl standing around was shot in the leg. she was taken to the hospital and is expected to recover. police still looking for the shooter in that incident and this comes after two oakland police officers were shot and wounded just doing their jobs bringing back calls to declare a state of emergency here in oakland. that from a council member who says we are completely out of control. the 8-year-old girl was shot yesterday afternoon on 65th avenue near international. police say several people were getting out of an suv when a car load of people pulled up and opened fire. bullets flew through the windows and homes of a wall. mothers on the block could only cry and console their own kids.

they didn't want to appear on camera for fear of retaliation. >> very disturbed. it's upsetting that we can't have our kids outside to play like normal kids like in other neighborhoods. >> last wednesday or thursday 10:00 in the morning it felt like it was right in front of my house. cannon fire. and that's crazy. we have kids. they were playing. i have kids that play in front all the time. they're not going to anymore. >> reporter: very frustrating. this is not new in oakland. children have been victims of gun violence recently in disturbing numbers. in 2011, 5-year-old gabriel martinez was shot and killed near his family's taco truck in east oakland. that same year a toddler was shot in an exchange of gunfire near a liquor store in west oakland and you may recall a 3 year old was shot when he was hit by a stray bullet while strolling with his family on international boulevard.

today later at 11:15 this morning, oakland police plan to hold a press conference talking about the two officers that were wounded but no doubt they'll talk about this 8 year old. reporting live in oakland, christie smith, "today in the bay." mixed news this morning out of santa clara's yahoo!. scott ask the said the company's earning didn't matter as much as the woman who delivered them. >> good morning, laura. wall street really likes marissa mayer. th they gave her a pass on the financial side of yahoo!'s business. this was a bit of a give me due to low expectations. yahoo! about 4% more money this year compared to last. that's not much. google's growth was around 22%. it also said revenue growth would slow going forward. what's far more important is mayer's leadership. she told reporters and analysts yahoo! employees listed 385 problems for her to solve and she was well on her way to solving them. mayer has made yahoo! a cool

think we'll see mainly 60s and maybe even close to 70 out toward the coast. during the day today we have high clouds going from north to south. you can see that. it will make for a nice sunrise. thin clouds really do a nice job making orange skies for the morning. 57 in san jose. 56 in san francisco. 62 in santa rosa. there you see the trend for the rest of the seven-day forecast. temperatures warming up thursday into friday. then a few extra clouds heading into the weekend. mike? >> all right. heading into the city we have a few more cars now waiting in the cash lanes at the bay bridge toll plaza. look at that. middle section there, those are fastrak lanes. metering lights on in 20 minutes this being traffic tuesday heavier volume builds quicker. look at the maps and approach and no problems. incline shows slowing toward the s-curve and that's traditional. 880 is slow southbound heading down toward the off-ramp. sounds like both vehicles involved in the crash are off to the shoulder but chp had to make a second sweep through the area

large storage tanks at the facility. two of which have already exploded and they remain to be on fire. they are having a tough time putting this one out. we know there are two burn victims so far. both 24 years old. we're also hearing reports from a fire marshal that two victims were allegedly smoking on top of the storage tanks when they exploded. the investigation continues there but not a very good situation. we continue to monitor that. it's 5:42 right now. today president obama will outline his immigration reform plan. he wants to beef up borders and keep 11 million illegal immigrants in this country. "today in the bay's" tracie potts joins us live with more details on president obama's plan. good morning. >> reporter: good morning. it's expected to be similar to what the democrats and republicans here on capitol hill pitched yesterday. two big components of that are border security and a path to citizenship for the so-called 11 million immigrants who are already in this country

illegally. here's the deal. conservatives want to make sure border security is ensured first before the 11 million immigrants are guaranteed the right to stay or the process to stay. it will be a process what they have put in place in this plan are background checks, fines, learning dpli ining english, a things to get to the back of the line to apply for citizenship. a lot of details to be worked out. civic and labor groups say they support this. they don't want to see it happen in a piecemeal fashion. in addition to tracking people that come into this country on visas, it would also require immigrants to prove that they have been working before they apply for citizenship. >> all right. a lot of details there. thank you very much, tracie. we can tell you a symbol of love in the south bay and a south bay town is coming unhinged. getting rid of dozen of padlocks

attached to a fence by lovers. bob redell has more on why town officials want to get rid of this display. good morning, bob. >> reporter: good morning to you, jon. for the past several months people have been putting these so-called love locks onto the main street fence over highway 17 to commemorate anniversaries and you've got mike and lindsey and people who put names on ink. it seemed like an idea to profess their love. caltrans says if you get too many locks on here it will be too much weight and this fence would be compromised. ultimate concern is if you have too many locks on here, it would fall down and hurt people driving underneath on highway 17. the city of los gatos which is responsible for the maintenance of anything above the deck said these locks will go and come friday they'll cut them down.

>> i think it's sad, you know. how are they hurting anything here with locks. >> i think it's a shame. it's a nice gesture. i don't know. romantic gesture. >> reporter: now there is still a plan b. the museum of los gatos stepped in and said, you know what? on valentine's day we'll unveil a new exhibit and have a bridge motif and chain link attached to it. don't know much more than that. it would be a place for people in los gatos to attach their so-called love locks on valentine's day. they are not new to the rest of the world in paris and florence, a couple pictures that colleagues took picture of in europe, love locks on those bridges for years. typically what happens is the authorities cut them down and throw them away.

nice thing about city of los gatos, they say come friday we'll take down these love locks. if you want to get your love locks, they're going to be at the town's corporation yard and that will be until february 15th unless you come here in vance to get them yourself. reporting live on the main street bridge in los gatos, bob redell, "today in the bay." we'll get a better idea of how the state's water supply is doing today. the second snow pack of the survey of the winter will take place this morning along highway 50. a snow survey found the water content was 134% above normal. it means we're less likely to have a drought in the summer. >> nice to have h20 flowing for us. would it be accurate to say a handsome forecast? >> if you like 60s and 70s. it's pretty. pretty nice. we'll talk about that in a moment. first, let's give you a sneak

preview to the snow pack survey. we went into december with these numbers about 130% to 140% of average. according to automatic gauges out there this morning in the sierra just checked, it looks like we're now into the 90% of average category. it's like going into a large lead at halftime at the snow pack and because january has been relatively dry, the numbers have pulled back a little bit but still well ahead of last year. if you remember last january snow pack below 50% of average. we'll see what the official physical survey shows but likely we'll see the numbers just below 100% of average as they do that survey along highway 50 later on this morning. 30s and 40s outside right now. not much wind to get your morning started. i think by the time the sun sets later today, you'll see northwest winds picking up 10 to 20 miles per hour heading into the afternoon. after that the winds hint at high pressure building in across the west coast and we're going to see 60s to near 70 by the time we get toward thursday and friday along the coast. for now high clouds dropping in from north to south as the pattern shift evolves today.

high pressure building back in and steadily as we go through the week you'll see warming starting wednesday, thursday and friday. mostly mid 60s and even near 70 around santa cruz finishing off the workweek. highs around the bay area today, upper 50s and probably a few low 60s outside. close to 57 in san jose. 60 in pleasanton. 59 toward fairfield and should see low 60s around santa rosa and parts of sonoma county and napa counties as northwest winds pick up. temperatures climbing up slow rise but again this is winter. mid to upper 60s pretty nice for this time of year. dry weather should take us into super bowl weekend and then probably this time next week, next tuesday, plan on the return of some rain and sierra snow in the forecast there. mike? >> we'll plan for that. plan for this as well. heading northbound on 880 and southbound both toward the san mateo bridge you're slowing. the southbound side because the commute is starting to build. traffic tuesday. just 10:00 to 6:00.
